Arrange for Care
Legally speaking, there is no law that allows you to arrange for care of your children after you’ve been arrested. However, when you are booked, it’s best to inform the officers immediately that you need to make a phone call so that your child can be looked after. It’s best to call either your spouse or the child’s other parent if possible. If that parent is out of the picture or lives far away, another relative or friend is your best bet.
That being said, since there are no laws, you may not be able to make this call. If so, you’ll need to ask the first attorney you see to obtain a court order so that you can call and arrange for the care of your child while you are in jail.
If your child is with you while you are arrested, this can be very traumatic on the child, especially if they are younger and don’t understand. In this case, the arresting officer may allow you to call someone before you are booked to come and get your child. Again, go down your list of caregivers in the order of importance.
If your child is in school or daycare when you are arrested, let the school officials know as soon as possible what your situation is and that they may need to call those on the approved list of relatives to come and pick up your child. You may also be able to arrange this, depending on the police officers at your station.
If no one can come and take care of your child and they are not able to care for themselves, Child Protection Services (CPS) will step in and care for them. This is not the preferred method of care for your child. Once your child is taken by CPS, you only have 48 hours to arrange for someone to pick them up or the child will become a dependent of the court. This only poses more legal hurdles for you to jump through once you are released.
Return Home As Soon As Possible
No child should be without a parent, and the younger they are, the harder it is. After you’ve arranged care for your children while you await your first court hearing or while you wait for a bail bond to be arranged, you should try not to worry and just focus on getting out of jail, preparing for your defense, and back to your family.
